THE FIFTH EDITION CAN BE ORDERED HERE We are currently working on the Sixth Edition of the casebook, which will be published by Aspen in 2009. The Sixth Edition will feature: (1) more material throughout the book on the legal and policy implications of the global climate crisis, (2) a complete revision of Chapter 5 on Air Pollution Control, the subject that has been most affected by new legal developments, and (3) a thorough updating of existing material in each chapter. For purposes of teaching the Environmental Law during the 2008-2009 academic year, the good news is that new developments do not necessitate any fundamental changes in our approach to the course. We have completed a first draft of the new Air Pollution Control Chapter (Chapter 5), which is posted below for your use in keeping the course up to date. This chapter contains edited versions of the Supreme Court's decisions in Massachusetts v. EPA and Environmental Defense v. Duke Energy, the D.C. Circuit's decision striking down the Clean Air Interstate Rule (CAIR), EPA's decision denying a waiver to California for new controls on greenhouse gas emissions from motor vehicles, and EPA's ANPR responding to the Massachusetts v.
